polarhubnexis provides demand forecasting analytics platforms and related services for e-commerce businesses. You may use our services only for lawful purposes and in accordance with these terms. You agree not to use the service:

• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the website

Payment and Billing

If you purchase services from polarhubnexis, you agree to pay all fees and charges incurred in connection with your account. All payments are due immediately upon receipt of invoice unless otherwise agreed in writing. We reserve the right to suspend or terminate services for non-payment.

All fees are quoted in Euros (EUR) and are exclusive of applicable taxes unless otherwise stated. You are responsible for payment of all applicable taxes.

Limitation of Liability

In no event shall polarhubnexis AS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Our total liability to you for any damages arising out of or related to these terms or the use of our services shall not exceed the amount paid by you to polarhubnexis in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless polarhubnexis AS and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees).

Governing Law

These terms shall be interpreted and governed by the laws of Norway, without regard to its conflict of law provisions. Any disputes arising from these terms or the use of our services shall be subject to the exclusive jurisdiction of the courts of Bergen, Norway.

If you are a consumer resident in the European Union, you also have the right to bring proceedings in the courts of your country of residence.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.

Severability

If any provision of these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
